Welcome to Eat'Em by the Ana's. These Terms and Conditions govern your use of our website and the purchase of any products from us. By placing an order, you agree to be bound by these terms.

General Terms & Product Information

Product Nature: All products are freshly baked, perishable, and handmade. Slight variations in color, size, and design may occur and do not constitute a defect.
Pricing: All prices are subject to change without notice. The price confirmed at the time of your order placement is the final price.
Intellectual Property: All content, designs, images, and logos on this website and our Instagram [@buildatreatt] are the property of Eat'Em by the Ana's and may not be used without explicit permission.

Custom Order & Payment Policy

Order Date Security: All custom orders (including cakes, bulk cookies, etc.) require a non-refundable deposit to secure the requested event date.
Non-Refundable Deposit: The required deposit fee is non-refundable. This fee covers the time spent on consultation, design, administration, and initial material costs. Your order date is not secured until this deposit is received.
Balance Due: The remaining balance for custom orders is due on day of pickup/delivery, unless stated otherwise. Orders not paid in full by the due date may be subject to cancellation.
Manual Payments: If you select the manual payment option (Cash/E-Transfer), the full balance is due at the time of pickup/delivery. We require exact change for all cash payments.

Cancellations, Returns, and Refunds

No Returns/Exchanges: Due to the perishable and custom nature of our products, we do not accept returns or exchanges. All sales are final.
Cancellation by Client: Cancellations must be requested within 48 hours of order confirmation. Cancellations requested after this period, or after baking/preparation has begun, will result in the forfeiture of all payments made, including the non-refundable deposit.
Quality Guarantee: If you believe your order was incorrect or significantly flawed, you must contact us within 4 hours of pickup/delivery with photographic proof. Refunds or credits will be issued solely at our discretion and only if the error was made on our part (e.g., incorrect flavor or size confirmed).

Pickup and Delivery

Responsibility for Items: Once the order has been picked up by the customer or successfully delivered to the confirmed address, Eat'Em by the Ana's is not responsible for damage, theft, or issues arising from improper storage (e.g., exposure to heat, damage during transport).
Late Pickup: Customers must pick up orders within their scheduled time window. Orders not picked up within 15 minutes of the scheduled time without prior notice may be cancelled without refund.

Allergens & Dietary Responsibility

Allergen Warning: All products are prepared in a kitchen that handles major allergens, including wheat, dairy, eggs, peanuts, and tree nuts (including almond extract). We cannot guarantee a 100% allergen-free product.
Customer Responsibility: It is the customer's responsibility to notify all consumers of the ingredients and potential allergens.

These Terms and Conditions are governed by the laws of the State of California, United States.
